Module summary
The general aim of the course is to impart a critical analytical understanding of International Insolvency Law. There will be a detailed consideration of the EUropean Insolvency Regulation as well as the UNCITRAL Module Law on cross-border insolvency and it's implementation in different countries. There will also be a considertation of the general principles of international insolvency law including the underlying concepts of universalism and territorialism plus an analysis of the common law and statutory vehicles for cross-border insolvency co-operation.Objectives
On completion of this module, students should be able to:- Understand the scope, structure and purpose of international insolvency law including policy material and the economic and political context of the subject matter.
- Understand the part that the law pertaining to insolvency plays in the development of national economies.
- Master the conceptual building blocks of a relatively discrete but interlocking body of legal knowledge.
- Research and synthesise primary and secondary materials on law and policy pertaining to international insolvency.
- Critically evaluate the appropriateness and effectiveness of existing legal dispensations in the sphere of international insolvency including their implications for business and economic activity.
- Understand the role of policy actors in the process of law formation in this sphere.
- Produce a substantial piece of individual written research work reflecting the above objectives.
