Pre-requisite qualifications

Completion of pre-requisite modules (for example, LAW5480M Introduction to the Constitutional and Institutional Structures of the EU).

For students studying this module as an elective, the module is mutually exclusive with LAW5320M European Business Law and LAW5440M Competition Law.

Module summary

Objectives

The module, proceeding from foundational knowledge of students about the EU and its law, focuses on economic constitutional law of the European Union, offering a theoretical perspective as well as an introduction to topical issues of internal market law and competition law in the EU.

It aims to convey a deepened knowledge of EU economic law and policy.

Learning outcomes
On completion of this module, students should be able to:
- understand the legal framework of European economic integration
- analyse the multi-level character of European economic integration
- critically discuss the interrelation of removing obstacles of free movement and competition and safeguarding a fair and sustained working of the Internal Market in the EU
- understand modes of governance in European Economic Integration.

Skills outcomes
On completion of this module students should be able to:
- critically assess legal rules against the background of diverse legal traditions
- advise policy makers and lawmakers on issues of European economic integration
- assess whether certain implementations of directives are in line with EU law, ability to advise on the use of EU law in national cases in the field
- critically analyse decisions and judgments in the field of EU economic law
- compare and contrast, as between the different areas of economic integration studied.


Syllabus

- Introduces to the notion of an economic constitution (first seminar) and
- proceeds to advanced lectures in:
> free movement law (2 seminars, covering the relation of positive and negative integration and the relevance of general interests and national policies) and
> competition law (2 seminars, covering the relation of market competition and state economic policies, the potential limits of and gains through economic services of general interests etc).

The analysis of all these is based on case law as well as legislation, their implementation/effects in different legal orders as mirrored in their doctrinal and theoretical reflection.

Private study

- 60 hours preparation for seminars on the basis of provided reading list
- 30 hours self-directed reading and reflection after seminars
- 50 hours preparing essay and presentation.
