Objectives
On completion of this module, students should be able to demonstrate:-- A knowledge of key issues and principles pertaining to the areas of torts selected for study
- An ability to manage their own learning, and to make use of primary resources
- An ability to engage in critical evaluation of the law of torts
- An ability to answer hypothetical legal questions relating to torts
- An ability to identify major underlying policy themes and possibilities for reform in this area of the law
Along with Contract, this module forms the grounding in private law. Both subjects play a key role in developing students' skills in reading and analyzing case law and statutes.
Syllabus
Nature and scope of tort law
Pervasive ancillary matters: vicarious liability, multiple tortfeasors, damages
Negligence: duty of care, breach and damage (includes occupier's liability to entrants)
Landowners' liability to neighbours
Intentional torts to the person
Defamation and privacy
The course aims to give a taste of the broad reach of tort law in relation to property and financial losses and dignitary wrongs and not merely accident law. Attention will be drawn to the relationship of torts with other branches of private law, in particular Contract. Material will be included from other jurisdictions and from Civil law systems.
