Module summary
This module examines the legal regimes which are in place to control some forms of environmental pollution. The main issues addressed in the module consist of: (1) Introduction - global environmental problems and the framework of environmental controls in England and Wales. (2) Water pollution. (3) Waste management. (4) Integrated Pollution preventions and Control. (5) Regulatory enforcement policy, civil law compensation claims and alternatives to the 'Command and Control' regulatory model of pollution control. This module is taught by lectures and seminars in semester 1. Assessment is by one 3000 word essay.Objectives
To provide an introduction to the role of law as a technique in the regulation of polluting discharges to water, land and air. To examine environmental law and enfocrement and sanctions policy in the context of real life pollution incidents.Syllabus
Pollution control law derived from EU law, common law rules, statute (both primary and secondary legislation). Techniques of legal regulation: permit-based controls linked to environmental standards. Enforcement and sanctions law and regulatory policy guidance.
