Module summary

The purpose of this module is to provide an introduction to key concepts in the field of commercial and contract management; through the use of case studies, to create a critical understanding of the scope and purpose of the field, an analysis of its commercial and economic functions, the impacts of emerging technology on the form and nature of contracts, the ethical framework underpinning the field and the extent to which it is a profession and / or an occupation.

Objectives

The purpose of this module is to provide a common understanding and definition of commercial and contract management, their business purpose and key influences, the role they play in the delivery of a successful business strategy and the impact of new technologies. It will allow students to evaluate different perceptions of role and process, both within different organisations and across industries, and to reach a common understanding of the scope and purpose of high-performing commercial and contract management, in particular in the context of business strategy in the post-COVID-19 world.

Learning outcomes
After completing the module the student should be able to:
1. Demonstrate an understanding and critical awareness of the role and function that commercial and contract management play in modern business and trading relationships
2. Critically evaluate the scope of the developing field, the extent to which it can be described as a profession and its relationship to other professional and occupational groups
3. Identify the commercial and economic impact of commercial and contract function.
4. Demonstrate an understanding of ethical questions and ethical standards in the commercial and contracting process
5. Demonstrate awareness of the role and impact of modern technologies on the performance and value of the contracting and commercial process


Syllabus

· What is Commercial & Contract Management (CCM): establishing a common definition of scope
· The interaction with law and the role of lawyers in commercial practice
· Why CCM matters and understanding the drivers of change:
o Scale of global contracting – economic value and value leakage
o Technology and data o Legislation and regulation
o Reputation and ease of doing business
o Social expectations and sustainable societies
o Government and geopolitics · Introduction to contract and relationship models / types and impact on required capabilities
· How CCM is applied: industry and geographic factors impacting process, priorities, practices and organisational models
· CCM as a ‘profession’ · Ethics and ethical standards in the CCM process: impacts of COVID-19

Opportunities for Formative Feedback

Online learning materials will provide regular opportunity for participants to check their understanding. Regular group activity embedded into learning will allow self and peer assessment providing opportunities for formative feedback from peers and tutors. Group on-line activity will include an initial presentation of key points for inclusion in the assessment exercise, allowing comment and feedback to the student.
