Module summary

This is a foundational level module in EU law, taken by all law students. It will be of interest to students of politics, international relations and those taking programmes of which EU studies is a component. The module considers the history and structure of the EU and the development of EU law and the role that law has played in the process of integration, by means of doctrinal development by the Court of Justice of the European Union. Particular attention is given to the constitutionalisation of the EU through case law, Treaty reforms and other mechanisms. The course also focuses on substantive law and the provisions which form the basis of the internal market: Free Movement of Persons, of Goods and of Services plus an introduction to competition law. The module provides opportunity to study the constitutional and institutional structures of the EU, the way in which EU law impacts upon national law, and law-making in the internal market.

Objectives

European integration is an ongoing project thus change is continual and keeping abreast of developments requires stamina and determination. In addition, misleading reports in the press can create confusion. Using a variety of materials – journal articles, case law and official documents - this module aims to give students a thorough grounding in this world of law through exploration of the constitutional and institutional foundations of the EU and specific core topics of substantive law.

Learning outcomes
On completion of this module students will be able:
- to demonstrate a foundational knowledge of the evolution and constitution of the European Union;
- to demonstrate an understanding of the EU institutions;
- to provide a sufficient knowledge of the core areas of EU substantive law (law of the single market; the individual and EU law);
- to demonstrate critical skills of research, analysis and interpretation;
- to understand the key themes underpinning the role of law, legal institutions and legal actors in the European Union.

Syllabus

Introduction to constitutional and institutional EU law with a focus on:
- historical overview of European integration;
- the character of the EU legal order; interaction of Union law with national and international law
- the profile and tasks of the central EU institutions, inter-institutional relationships and the law making process
- administrative and judicial enforcement in the CJEU, the national courts and national administrations

Introduction to substantive law with a focus on:
- the provisions concerning free movement of goods, persons and services;
- foundations of EU competition law
- regulatory innovation
