Module summary

This module will provide you with a critical understanding of the key legal concepts and theories of global governance. We will explore growing multi-level governance through examining legal frameworks and institutions. The roles of the intergovernmental organisations such as the United Nations, with States and Non-State Actors, will be analysed. The diversity of bodies and interests in making, interpreting and implementing international law require analysis as to whether there is a pattern of organised, rule-governed, coordinated behaviour. The role of politics, power and decolonising theories will also be considered, to understand how law is made at the global level.

Objectives

This module will introduce and inform students with several contemporary theories of global governance and international law. After contextualising governance of global issues, the module will provide a foundation for understanding the problematic area of sources of international law and multiple sources of authority with the effects of fragmentation. Responses through global legal pluralism, private actors and decolonising approaches will be analysed. The module will explore academic, legal practitioner, and civil society approaches and their contributions to addressing real-world problems.

Learning outcomes
On successful completion of the module students will have demonstrated the following learning outcomes:
1. Understand global governance through law theories, concepts, normative principles and disputes;
2. Discover the place of multi-level governance through legal and political frameworks and institutions, and the role and influence of State and Non-State Actors in the law-making process;
3. Critically analyse how theories and philosophies of Global governance through Law may be applied to on-going, real world global challenges through diverse contemporary academic, expert, practitioner sources;
4. Critically evaluate strategies for a global order based on principles based of decolonising approaches, equity, sustainability, social justice and human rights.

Skills learning outcomes
On successful completion of the module students will have demonstrated the following skills learning outcomes:
1. An ability to locate and synthesise the findings and arguments of a range of source materials, in order to draw informed conclusions
2. An ability to think critically in respect of theory development and hypotheses
3. An ability to analyse the transferability of theories within the contexts of ‘real world’ settings
4. Strong presentation skills.

Opportunities for Formative Feedback

A formal formative assessment opportunity will be provided, which is specifically pedagogically aligned to the summative assessment task. As part of this, each student will receive individual feedback designed to support the development of knowledge and skills that will be later assessed in the summative assessment.
