Module summary

In this module, the central issues of arbitration as a form of dispute resolution will be analysed. The module will focus on the theory and practice of international commercial arbitration. The aim and objective of the module is to ensure students are able to understand the conceptual structure of international commercial arbitration and the strengths and weaknesses inherent in this form of dispute resolution.

Objectives

To lead students to an advanced knowledge of the law of arbitration, contrasting arbitration to other forms of dispute resolution and considering the central issues of the current law of arbitration. To lead students to an ability to critically evaluate arbitration as one of the alternative forms of dispute resolution.

Learning outcomes
On completion of this module, students will have:
1. Gained an in-depth knowledge of the central issues in the law of arbitration
2. Developed a critical understanding of the relationship between arbitration and other forms of dispute resolution
3. Developed an ability to critically evaluate the current law of arbitration
4. Understand where arbitration law fits in the legal systems 
5. Studied the nature of the arbitration agreement

Skills learning outcomes
On successful completion of the module students will have demonstrated the following skills learning outcomes:
1. Critical thinking, demonstrating openness to alternative ideas and have the ability to interrogate sources
2. Develop academic skills to enable you to source, understand and apply your discipline
3. Be able to evaluate and analyse a range of information to put forward coherent and evidence based arguments
4. Develop advanced communication skills, essential for effective interaction and the dissemination of complex concepts.

A formative assessment opportunity will be provided.

A formal formative assessment opportunity will be provided, which is specifically pedagogically aligned to the summative assessment task. As part of this, each student will receive individual feedback designed to support the development of knowledge and skills that will be later assessed in the summative assessment.
