Module summary

This module comprises an introduction to the main principles of the law of obligations, the first of the 'great pillars' of English private law. Attention will be principally directed towards the law of contract and the tort of negligence. - This module is taught by lectures and seminars in semester 1. - Assessment is by two 1,500 word essays.

Objectives

It is expected that students will gain an understanding of the nature of obligations, and their correlative rights, arising under English private law, together with an appreciation of the ways in, and extent to which, such obligations and rights may be enforced.

Syllabus

This module considers the legal implications of entering into a contract, being negligent or being subject to the negligence of others, and what happens when an individual receives an unfair benefit.

We will examine the three nominate categories of obligation, that is obligations arising from consent (ie contract), wrongs (ie tort) and unjust enrichment.

In addition to examining the nature and content of these obligations, we will consider the various remedies available on a breach of duty.
