Objectives

This module explains the key elements of the employment relationship by reference to UK and EU law. Extensive use is made of primary legal sources such as statute law and case law so that legal problem solving techniques can be introduced. The module distinguishes different sources and categories of law and explains key legal concepts.

Learning outcomes
Upon completion of this module students will be able to:
- Explain key legal concepts and areas of employment law
- Conceptualise the broad scheme of the law in the areas covered by the course
- Locate and analyse key statutory provisions and case law

Skills outcomes
Upon completion of this module students will be able to:
Subject specific
- Analyse situations and identify the relevant employment law for the purposes of advising the employee/employer
- Apply the law and draw conclusions about the legal implications for management

Transferable
- Solve problems and communicate referenced decisions clearly in writing


Syllabus

The module is designed to provide an understanding of both individual and collective employment law; It is organised so that it follows the sequence of the employment relationship.

That is, after an introduction to the contract of employment and classification of the employment relationship it deals with recruitment and selection, with terms and conditions of employment and the statutory floor of employment protection rights and with questions of termination.

The module covers discrimination law including sex, race and disability discrimination and equal pay; It deals with the system of employment tribunals and with the law relating to trades unions. An important feature of the course is the integration of EU law throughout.

Students will have to complete an online assessment at the end of the module. This will take place during the examinations period and will be time bound. The assessment will not take 48 hours to complete, but students will have a 48 hour time period in which to complete it. The resit for this module will be 100% by 3 hour examination.
