Objectives

To provide an introduction to the philosophy behind, and principal institutions of, the British constitution with special reference to its impact in law and an overview of the basic methods of legal control over administrative bodies.

Syllabus

In regard to principles, the following issues will be addressed:
- Constitutionalism, including concepts of the rule of law and the separation of powers and the position of the courts;
- Democracy and the working of electoral law;
- The treatment of individual rights with reference to domestic law and European jurisdictions; traditionalism, which includes the consequences of an unwritten constitution;
- Sources of law (including conventions) and pressures for reform;
- Parliamentary sovereignty, including its impact in relation to the Acts of Union, the position of Northern Ireland and the relationship with the European Community.

In regard to institutions, the following will be covered:
- The Crown, with the emphasis upon the sources of powers, such as the prerogative and delegated legislation;
- The Prime Minister, the Cabinet, the civil service, their functions and relationships;
- Parliament, with the emphasis on its role in the passage of legislation and control of the executive.

Internal review mechanisms, tribunals and inquiries, Judicial review, ombudsmen, actions in private law.
